The agreement behind VaryClip.

These terms govern your account, subscription, and use of the VaryClip software and website.

1. Operator and acceptance

VaryClip is operated by Artem Gorchakov, an individual based in Kazakhstan. By creating an account, purchasing a plan, or using VaryClip, you agree to these Terms, the Privacy Policy, and the Refund Policy. If you do not agree, do not use the service. Questions may be sent to support@varyclip.com.

2. Eligibility

You must be at least 18 years old and legally able to enter into this agreement. If you use VaryClip for another person or organization, you confirm that you have authority to bind them.

3. What VaryClip provides

VaryClip is a local-first browser application that converts one source video into a package of one to five technically distinct MP4 variants. One completed package counts as one use, regardless of the chosen output count. Failed preflight, failed or stopped incomplete processing, restored downloads, and ZIP downloads do not create an additional use.

4. Your content

You retain all rights you have in your content. Because media processing happens on your device, VaryClip does not need a license to store or host your footage. You are responsible for having the rights and permissions needed to process, publish, and distribute every input and output.

5. Acceptable use

You may use VaryClip for lawful production and testing. You may not use it to infringe rights, distribute illegal or harmful material, deceive people, evade lawful platform enforcement, interfere with the service, probe security, automate account creation, resell access, or abuse free trials, refunds, or usage accounting. You remain responsible for following the rules of every platform where you publish.

6. Accounts and security

Provide accurate account information and protect access to your email, Google account, device, and active sessions. Tell us promptly about suspected unauthorized access. We may suspend or close accounts reasonably believed to be compromised, fraudulent, unlawful, or in material breach of these Terms.

7. Subscriptions and automatic renewal

Paid plans renew automatically at the interval and price shown at checkout until cancelled. Lemon Squeezy acts as merchant of record and processes payment, applicable taxes, receipts, and billing details under its buyer terms. You can cancel in VaryClip Account; cancellation stops future renewal and access continues through the paid period unless the law or Refund Policy requires otherwise. Plan features and usage allowances are shown before purchase.

8. Refunds

Refund eligibility is governed by the Refund Policy, together with mandatory consumer rights that apply to you. Cancelling a subscription does not itself refund a completed billing period.

9. Availability and local processing

Performance depends on browser capabilities, device resources, free storage, input format, operating-system media support, and third-party platform changes. We may block an input before processing when a safe result cannot be confirmed. We may update, limit, or discontinue features, but will not intentionally remove paid access without an appropriate remedy required by law.

10. No performance promise

VaryClip creates technically distinct media files and additional opportunities to test content. It does not control or guarantee views, reach, recommendations, monetization, moderation decisions, account status, or any other outcome on a third-party platform.

11. Intellectual property

VaryClip, its software, interface, brand, and documentation belong to the operator or applicable licensors. Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable and revocable right to use the service during your permitted access.

12. Disclaimers and liability

To the fullest extent permitted by law, VaryClip is provided on an “as is” and “as available” basis without implied warranties. We are not liable for indirect, incidental, special, consequential, or lost-profit damages, loss of content, or third-party platform decisions. Our aggregate liability for claims relating to VaryClip will not exceed the greater of USD 100 or the amount you paid for VaryClip in the 12 months before the event giving rise to the claim. These limits do not apply where they are prohibited by law or to liability that cannot legally be limited.

13. Termination and deletion

You may stop using VaryClip, cancel a subscription, and request deletion from Account. We may suspend or terminate access for material breach, fraud, security risk, legal obligation, or misuse. Sections that by nature should survive—including payment records, ownership, disclaimers, liability, and dispute terms—remain effective after termination.

14. Governing law

These Terms are governed by the laws of Kazakhstan, without regard to conflict-of-law rules. Courts with jurisdiction in Kazakhstan will hear disputes, except that mandatory consumer protections and forums available under your local law remain unaffected.

15. Changes

We may update these Terms for legal, security, or product reasons. Material changes will be posted with a new date and communicated when appropriate. Continued use after the effective date means you accept the updated Terms; if you do not, you may cancel before renewal.
